Location-based access restriction. If your IP address resolves to a restricted state, Kalshi blocks your access to trading. You can still log in and withdraw funds — trading is blocked, not your account.
State court orders require Kalshi to stop operating in that state. Geofencing is the minimum-compliance response while federal appeals proceed.
Affects only the restricted state. Every other state is unaffected.
Not a national shutdown. Kalshi holds a CFTC Designated Contract Market license that covers all 50 states. State court orders don't revoke that federal license.
Not a freeze of your funds. CFTC rules require DCMs to segregate customer funds. Account balances are not at risk from a state enforcement order against the exchange.
Confirm withdrawal availability directly with Kalshi support if you are in a restricted state.
Kalshi access blocked or restricted as of August 5, 2026
Judge Judge John McHale issued a final order effective 2026-08-13. Nick Brown pursued under Washington Gambling Act.
Judge Rosemarie Aquilina, Ingham County Circuit Court, $120,000/day fine for non-compliance. CFTC Release 9267-26 (Jul 14) orders Kalshi to fulfill trades — dual-authority standoff ongoing.
Judge Katherine Menendez issued a 44-page preliminary injunction order. Minn. Stat. § 609.7615. State law argument prevailed at PI stage; CFTC preemption defense continues on appeal.
Kalshi has restricted access in Nevada. Check Kalshi's official state access page for current status. Exact enforcement basis: confirm at Kalshi.com/states.
Alternatives when your state restricts Kalshi — what each one actually offers
No direct substitute exists. Kalshi's full contract suite — politics, sports, finance, weather, entertainment — is not replicated on any other US-accessible platform. Polymarket covers many of the same categories but with crypto settlement. PredictIt covers politics with a $850 cap. For sports-focused traders in restricted states, licensed sportsbooks (where legal) are a different product entirely.
Practical steps — in order of priority
Check Kalshi's official state status page
Before anything else: confirm your state is actually restricted. Enforcement actions change frequently. The authoritative source is Kalshi's own platform, not third-party news reports.
Verify your account balance and withdrawal access
Log into your Kalshi account. Your balance should be unaffected. Confirm withdrawal is available. CFTC segregation rules protect your funds regardless of state enforcement status.
Close open positions if you cannot monitor them
If a geofence blocks your access to the trading interface and you have open positions, contact Kalshi support immediately. Document your positions. You retain rights to your contracts and any winnings.
Monitor the appeal timeline
State restrictions are temporary while federal appeals proceed. Track CFTC v. state proceedings in your state. If the federal court rules on CFTC preemption, restrictions in your state may be lifted. See the full legal tracker below.
The legal structure that makes geofencing possible
Kalshi holds a CFTC Designated Contract Market (DCM) license — the same type of federal authorization that covers CME and CBOE. Its position is that this federal license preempts state gambling laws under the Supremacy Clause of the U.S. Constitution.
State courts have so far disagreed — finding that preliminary injunctions and TROs are appropriate while the federal preemption question is litigated. These are not final rulings on the merits: they preserve the status quo while courts decide the underlying legal question.
Restrictions in your state depend on which circuit it sits in and what federal appellate courts rule on preemption. A favorable appellate ruling could lift restrictions without any state-level action. See the full legal threat tracker →
