FanDuel Predicts operates under a federal CFTC framework — not the state-by-state licensing structure used by sportsbooks. That means the platform can offer financial and economic contracts everywhere without needing individual state approvals.
Sports event contracts are a different story. Under FanDuel's own terms, it does not offer sports prediction markets in states where its sportsbook already has a presence. The logic: markets that overlap with sports betting run into state regulatory complexity that doesn't apply to interest rate or commodity contracts.
According to FanDuel's launch terms, the rule is straightforward: as new states legalize online sports betting, FanDuel Predicts will cease offering sports event contracts in those states. The financial and benchmark markets remain available everywhere regardless of the state's sports betting laws.
