Government Ethics Dispute

Prediction markets remain legal and operating
Some federal courts have found CEA preemption over state bans, though courts remain split — the 3rd Circuit ruled for preemption in April 2026, while courts in New York (July 7), Wisconsin (July 29), and Utah (August 4) have ruled against it. Whether CLARITY passes may affect how definitively that question is settled.
CLARITY would expand permitted event categories
If it passes, CLARITY would expand CFTC authority over digital commodity trading and reduce state legal friction — particularly for platforms operating on blockchain rails. But court victories already protect core operations.
